VAN HALEN STORY DOCUMENTRY DUE ON DVD:
The Van Halen Story: The Early Years is a DVD set to be released by Passport Video November 25. While no details of the feature are available as yet, the DVD is listed as a documentary. A little further digging turned up some information about the company behind this release. "Based in North Hollywood, California, Passport Video is a full service production company that launched its video and television production business in 1989. Passport owns a vast stock footage library, an extensive collection of over 16,000 trailers, 3,000 feature films and more than 90 years of news libraries plus interviews with over 2,000 celebrities and political/influential personalities. Original innovative programming is created utilizing film footage from the Passport Library, licensed film clips, archival footage, and interviews with celebrities and leading authorities relating to the specific subject". | I recently spoke to Sue Masino (http://www.susanmasino.com/) who was interviewed for this doc. She lives here in Madison, and told me that the production company flew her out to LA for an interview. She also said that the production company produces alot of these "documentaries" without any contact or consent of the bands they profile so I assume we can expect it to be without any official footage. |

You cannot use someone's image or music without their consent.

Actually, you don't need an artists consent! This is a VERY shady area. Like doing a cover song, I don't need Van Halen's permission to cut and release a song that they wrote, as long as residuals and royalties are properly allocated. Think about newscasts that use file footage while running a story. I don't know the whole deal, but I do know they don't need permission.
Anyone here a copyright lawyer?!? Cause i'm sure not!!!!! :D |

| This may be similar to that bunch of Kiss DVD's which are totally without consent from Kiss. They have lots of footage and images but none of the bands actual music, not even cover versions of their songs.. Its just midi files playing as background music to a narrator.. |

| Speaking of KISS. That one DVD "KISS:LIVE IN LAS VEGAS" is without the bands consent. I remember ole Green $immons putting out a statement saying this was not put out by the band. But it had to be legal cause it's still out there. And that was a live performance by the band that was supposed to go over the internet. |

It is unauthorized, but there are two things preventing us from treeing it.
1. It is commercially available (For sale in the US)
2. Jeff over at the VHStore is a respected member of the VH online community.
