Hey All

Im just curious now if a band like Metallica has sndbrds for download to its paying members ....Does that sndbrd become sort of an official release??

I would say no. If they released live cds like Pearl Jam did, then yes. :D :confused: :p :yell:

If the band makes available for purchase any recording, then yes, that recording becomes an "official release".

I consider them official releases because they sell them and if I recall, they are copyrighted just all their other releases.

Thx all for info...I had a feeling that maybe that would be the case :confused:

So basically if one of those audios are used on a DVD that would be copyright infringement ??

I'm not a lawyer, but I would say yes it is. To me, it doesn't matter what media is used - CD, download, whatever. If it's officially sanctioned by the band, then you can't use it. And when it comes to Metallica, you KNOW how they are about people $tealing their mu$ic.

Yes, if you go to www.livemetallica.com, there's plenty of shows for download and all are soundboard. In the vault section, there's always 15-20 shows to download FREE of charge., NOT all of the vault is soundboard. The shows you pay for run around $9.95 for the entire show in MP3 format or around $13.00 for FLAC format. I've downloaded a variety of things from the vault, never bought any as I've traded for most of the Metallica boots I have, which now number close to 100 audio shows.

As far as the band considering them "official" I would say no. I think these live shows are considered "in addition to our catalog of studio albums."

The same discussion came up on a Kiss board in the last week.

There's video with crappy audio, and there's the Instant Live cds.

It's been decided that anything that is authorized by the band and is available for purchase will not be allowed.

Nothing stopping this from being done and shared on a site with lesser morals.

What if it's authorized by the band but available for free? Will the Kiss board allow it? I personally think that's ok. You're not stealing any potential income form the band in that case.

And that's the case for Metallica since they have 15-20 free shows. It's probably not the case for Kiss because they don't give away anything for free LOL! But I would have said the same thing about Metallica without knowing any better so what do I know?

Its still the bands Property free or not they released the audio....

Legally you probably shouldn't circulate any stuff in any circumstances. However in practice we like to trade this stuff - it's v.dubious when the band in question puts out a top quality legit release, however if the band puts out a hatchet job of various nights as 1 DVD in my mind it's morally ok to trade these dates as long as you buy the official release (although as I state in line 1 it's probably illegal)

This has came up quite a bit over at metpage & metfuk. During the 03-04 tour several aud shot dvds had the live met audio added. It made for a nice package, but a grey area for sure.

At the JITF bootleg site you can download the livemet audio mp3s about an hour or so after they are official released. Same with demoniod.

Not sure what the answer is, but you probably wouldn't want to torrent it with official material just to protect yourself.

Guy, at your Stagefright site, don't you also have a lot of IEM tapers. I would think that may be a grey area as well for adding to a dvd.
