RALEIGH -- North Carolina's ban on ticket scalping wouldn't apply to people who resell event tickets online as part of a measure that's cleared a House committee.
Current state law prohibits tickets from being sold for more than $3 above face value. But the bill approved Thursday by the House Commerce Committee would carve out an exception for online sales.
The bill also assesses a 3 percent privilege tax on the sellers' profit.
Republican Sen. Fletcher Hartsell of Cabarrus County said the measure would create a mechanism to control currently illegal transactions that are happening every day.
The bill already has passed the Senate. It now goes to the House Finance Committee. |

Most states allow ticket resell. I always find it funny that people say that ticket selling is illegal. In fact when the entire Hanna Montana ticket situation was in the news, five states had or where about to relax their resell laws.
Here is a list of the few stated that do have policy on reselling tickets.
Arkansas, Kentucky, Michigan, Alberta (CA), Manitoba (CA), Ontario (CA)
No more than face value.**
North Carolina
No more than face value plus $3.
Florida
No sale of multi-day or multi-event tickets that have been used at least once for admission.
Georgia
Only the original purchaser, a charity or a licensed broker may sell for more than face value.
Massachusetts
No more than face value plus $2 (except that a ticket broker licensed by the state may charge for certain additional expenses related to acquiring and selling the ticket).
Mississippi
No more than face value for events held on state owned property and athletic contests at Mississippi colleges and universities; no limits on other events.
Missouri
No more than face value for sporting events; no limits on other events.
New Jersey
No more than face value plus the greater of 20% of the ticket price or $3.00 (except that a registered ticket broker or a season ticket holder may accept a premium of up to 50% of the price paid to acquire the ticket).
New Mexico
No more than face value for college athletic events; no limits on other events.
Rhode Island
No more than face value plus the greater of 10% of the ticket price or $3. |

| Well, it used to be you couldn't sell over 3 bucks per ticket in NC, but it changed a couple of years ago. Tickets have been getting scalped online for this state for at least the last couple of years. It's really hard to get good tickets for shows now. |

I disagree, i find it easier to get good seats cheap when brokers over buy a show. That is why this year is tougher for me. With the economy slowed down the brokers are only buying prime seats, so they never have a excess of inventory. Using Ebay as a guide Las Vegas only has 219 auction for tickets at this time. The normal summer inventory is usually well over 2000. With very little inventory I can not get steals as much. |

I prefer scalped tickets I will pay more so I can get the event ticket a few days before the show and sit where I want.I don't wana try to buy a ticket 2 or 6 months out and not get a decent ticket or rely on luck.I can not always be around when tickets go on sale also.
You can also get tickets below face value sometimes or at or very close to for very nice seats.Obviously it can cost more but if you buy a few days before an event from craigslist,stubhub or ebay you should be fine. |
